Official Rules and Regulations (“Official Rules”)

THIS CONTEST IS ONLY OPEN TO RESIDENTS OF CANADA AND IS GOVERNED BY CANADIAN LAW. By entering “2012 Great Green Challenge” Contest (“Contest”), entrants agree to abide by these Official Rules. The decisions of the independent contest organization with respect to all aspects of the Contest are final. The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. You understand that you are providing your information to Whirlpool Canada LP and not to Facebook. The information you provide will only be used to administer the Contest in accordance with the Whirlpool Canada LP privacy policy located at www.whirlpool.ca. Facebook is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to Whirlpool Canada LP and not Facebook.

NO PURCHASE NECESSARY: The Contest is sponsored by Whirlpool Canada LP (the “Sponsor”). The Contest begins at 12:00 PM Eastern Time (“ET”) on January 5, 2012 and ends at 12:00 PM ET on February 6, 2012 (the “Contest Period”). Three (3) eligible families will be selected to participate in the Sponsor’s “2012 Great Green Challenge” program (“Program”) wherein they will be challenged to reduce their energy consumption by making simple changes to their lifestyle and by using energy-efficient Whirlpool® home appliances.

1. ELIGIBILITY:

To enter the Contest, you must be a legal resident of Canada, be at least the age of majority at time of entry in the Province or Territory in which you reside and not be an employee of the Sponsor, its affiliated companies or agents, their respective advertising or promotional agencies, its media sponsors, or the third parties engaged by the Sponsor to assist it in administering the Contest or a member of any such employee’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the employee or not). In these Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner and/or spouse. The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sponsor reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

2. HOW TO ENTER THE CONTEST:

Limit of one (1) entry per person during the Contest Period. You may use only one (1) email/home address and only one (1) Facebook account per person to enter the Contest. To enter the Contest, visit facebook.com/whirlpoolcanada (the “Contest Website”) and complete the online entry form (the “Entry Form”) with your full name, daytime telephone number (including area code), home address, valid email address, confirm that you are at least the age of majority in the Province or Territory in which you reside, confirm compliance with the Rules of the Contest and indicate whether you wish to receive information regarding upcoming events and/or promotions from the Sponsor. Enter the year of purchase for your refrigerator, range, dishwasher, washer and dryer in the corresponding fields. Next, upload a photo (see rule 3 for photo format and content) of you with an appliance currently in your home, submit a short story (see rule 3 for story format and content) titled “Why I deserve to participate in the Whirlpool Canada 2012 Great Green Challenge” and upon doing so, click “Submit”. After you click “Submit”, your photo and story (herein referred to as the “Entry”) will be reviewed by the Sponsor (or its designated representative) to determine if it meets the requirements outlined in rule 3.

Although online access and an e-mail account are required in order to participate, no purchase is required in order to enter the Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free e-mail accounts.

ALTERNATE ENTRY: Mail in the following information on a [size 5” x 7”] paper: your full name, daytime telephone number (including area code), home address, valid email address, together with a [size 5” x 7”] colour photo of you with an appliance currently in your home and submit a short story (1400 characters or less) titled “Why I deserve to participate in the Whirlpool Canada 2012 Great Green Challenge” to: The Whirlpool Canada “2012 Great Green Challenge” Contest, 111 Queen Street East, Suite 200, Toronto, ON M5C 1S2.

If you are a selected entrant, you must:

  • Enter into an Agreement with Sponsor to actively promote the Program, including media interviews (newspaper, magazine, television, radio, online), presentations and/or photo shoots;
  • Provide a minimum of twelve (12) blog posts and a minimum of twelve (12) photos for six (6) weeks in relation to your activities to reduce energy and save resources;
  • Be available and in town between February 8th, 2012 up to and including April 30th, 2012 (exact dates and times to be provided in advance by Sponsor, or its representative) to actively promote the Program;
  • Be legal owner of the home that you have based your story on;
  • Have wireless internet/router for remote monitoring;
  • Have a meter that is supported by BlueLine Innovations brand remote monitoring devices (note: Landis & Gyr Focus meter brand not supported);
  • Provide copies of your hydro bills between 2010 and 2012; and
  • Be present at home to grant Sponsor entry to install new appliances in your home at a time mutually agreed to by you and Sponsor.

If eligible, your Entry will be considered an official entry into the Contest and will be uploaded to the Contest Website. Any Entry that the Sponsor and/or its designated representative(s) deems, in its/their sole discretion, to violate the terms and conditions set forth in these Rules will not be posted. Prior to being posted, the Sponsor and/or its designated representative(s) reserve the right, in its/their sole discretion, to edit or modify any Entry, or to request that the entrant modify or edit his or her Entry, in order to ensure that the Entry complies with these Rules, or for any other reason. In the event it is determined that an entrant has entered in a fashion not sanctioned by these rules and/or has submitted more than the number of Entries permitted by these rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified.

Entries must be received on or before 12:00 PM ET on February 6, 2012 (the “Contest Closing Date”). The Sponsor, in its sole discretion, reserves the right to terminate the Contest or extend the Contest period, if an insufficient number of eligible, complete, tasteful, or appropriate entries are received.

Each Entry is subject to the approval of the Sponsor and must satisfy all the requirements set out above and be submitted in accordance with these Rules.

3. PHOTO FORMAT & CONTENT:

Each submitted photo:

  • may be submitted only once;
  • must be submitted in JPEG file format
  • must be a photo of you with one or more of appliance in your home of permanent residence
  • must be no more than 4 megabytes (mb) in file size
  • must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons, including persons 13 years of age and younger;
  • must not, in the sole and unfettered discretion of the Sponsor, contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate, unsuitable or offensive content, including, but not limited to, crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic);
  • must not, in the sole discretion of the Sponsor, contain any commercial content, comparisons or solicitations that promotes any product or service other than that of the Sponsor;
  • must not contain any copyrighted works (other than as owned by the Contest entrant)
  • must not contain any reference to competitor appliance trademarks/logos; (any competitor appliances appearing in your photo must blur out the trademark/logo so as to be unrecognizable);
  • must not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from each such individual and his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence (note: if you cannot obtain the consent of an individual appearing in your photo, then his/her face must be blurred out so as to be unrecognizable);
  • must contain entirely original materials and entrant must have all necessary rights (including, without limitation, consent of the photographer) in and to the photo to enter the Contest;
  • Must not violate any law; and
  • Must not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever.

The Sponsor and/or its promotional agency or designated content moderator (the "Reviewer") will initially screen every photo. Any photo that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Official Rules will not be posted. Prior to being posted on the Website, the Reviewer reserves the right, in its sole and absolute discretion, to edit or modify any photo, or to request an entrant to modify, edit and/or re-submit his or her photo, in order to ensure that the photo complies with these Official Rules, or for any other reason.

4. STORY FORMAT AND CONTENT:

Each submitted story:

  • may be submitted only once;
  • must explain why you believe you deserve to participate in the Whirlpool Canada “Great Green Challenge” Program;
  • must provide age of your refrigerator, range, dishwasher washer and dryer;
  • must be no more than 1,400 characters
  • must be in English OR French;
  • must be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons, including persons 13 years of age and younger;
  • must not, in the sole and unfettered discretion of the Sponsor, contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate, unsuitable or offensive content including, but not limited to, crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic);
  • must not, in the sole discretion of the Sponsor, contain any commercial content, comparisons or solicitations that promotes any product or service other than that of the Sponsor;
  • must not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and
  • must not contain any copyrighted works (other than as owned by the Contest entrant);
  • Must not violate any law;
  • Must not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever; and
  • must contain entirely original materials.

5. PRIZE:

Each of the three (3) families selected to participate in the Sponsor’s “Great Green Challenge” program will receive five (5) Whirlpool® home appliances consisting of:

  • one (1) Whirlpool Gold® Dishwasher, Model #WDT910SSYM, with a manufacturer’s suggested retail price (“MSRP”) value of $949.00†;
  • one (1) Whirlpool Gold® Free Standing Range, Model #YGGE390LXS, with MSRP value of $2,149.00†;
  • one (1) Whirlpool Gold® French Door Refrigerator, Model #GI6FDRXXY, with MSRP value of $2,499.00†;
  • one (1) Whirlpool Cabrio® High Efficiency Washer, Model #WTW8800YC, with MSRP value of $1,199.00†; and
  • one (1) Whirlpool Cabrio® Dryer, Model #YWED8800YC, with MSRP value of $999.00†,

having an aggregate MSRP value of $7,795.00† (CDN) (collectively, the “Prize”).

The Prize must be accepted as awarded without substitution, is not transferable, assignable, not for resale and has no cash surrender value (in whole or in part). Fulfillment of the Prize is based on availability and the Sponsor reserves the right, in the event that the Prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability. Any costs or expenses associated with the Prize, including, but not limited to, installation of the Prize and removal of existing appliances will be the responsibility of the winner. The Prize includes delivery to one location in Canada. No transfer, assignment, cash redemption (in whole or in part) or substitution of prize is allowed.

6. SELECTION PROCESS/JUDGING OF ENTRIES/NOTIFICATION:

The selection process will begin on or about February 13, 2012 at 11:00 AM ET at 111 Queen St. E., Ste 200 in Toronto, ON from among all eligible entries received by the Contest Closing Date and will conclude on or before February 27, 2011. Entries will be screened and judged by a panel of judges as selected by the Sponsor based on the following criteria (the “Judging Criteria”):

  • Originality and impression of story and how it relates to the theme of the Contest;
  • Image quality of the photo; entry photo must be current and clearly depict the present state of the appliances described in the story; and
  • Entrant meets all criteria and complies with these Official Rules.

The judges, in their absolute discretion, shall select the winners based upon the above criteria. The decision made by the judges is final and binding and may not be challenged in any way. Odds of winning depend on the application of the Judging Criteria to the entrant’s Entry and total number of eligible Entries received by the Contest Closing Date. The selected entrant will be contacted by email or telephone within two (2) business days of being selected. If the selected entrant (a) cannot be reached by email or telephone within three (3) business days of being selected; (b) fails to correctly answer the skill testing question (see rule 7); or (c) fails to return the properly executed Release Form within the specified time (see rule 7), then he/she will be disqualified and another entrant will be selected by the same process until such time as contact is made by email or telephone with a selected entrant or there are no more eligible entries, whichever comes first. The Sponsor will not be responsible for failed attempts to contact a selected entrant. Sponsor reserves the right, in its sole and absolute discretion, to disqualify the entrant from participating in the Contest.

7. GENERAL:

By entering the Contest, each entrant (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry in favour of the Sponsor; and (iii) agrees to abide by these Official Rules and the decisions of the independent contest organization with respect to all aspects of the Contest, which decisions are final.

In order to win the Prize, the selected participant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a pre-arranged, mutually convenient time. The selected entrant will also be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with the Rules, acceptance of the Prize as awarded, without substitution, and releasing the Sponsor, its dealers, agents, affiliated and related companies, advertising and promotional agencies, the independent contest organization and their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releasees”) from any liability arising out of or in any way connected with the operation of this Contest and use of the Prize. The Prize winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the Prize and from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relate in any way to the Entry. The Release Form must be returned within the time period specified on the Release Form or the Prize may be forfeited. Upon receipt, Sponsor, or its representative, will inform winner of details related to how the winner will receive the Prize.

The Releasees shall not be liable for any damages caused or alleged to be caused by or resulting from any entry, prize or other correspondence or data that is lost, stolen, late, garbled, distorted, delayed, damaged or misdirected for any reason, including but not limited to: (i) any failure, interruption, technical malfunction or delay; (ii) any e-mail, text or other communication sent or received to or from the Sponsor or any of its agents or designees, for any reason; (iii) for any incorrect, untimely or inaccurate information, whether caused by the web site where this Contest was featured, users or by equipment or programming errors associated with or utilized in the Contest; (iv) any technical or human error which may occur in the processing of any entry or entries in the Contest; for problems with the function of any website or website feature, howsoever caused; (v) the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data, software, online systems, servers or access providers; (vi) any functionality lost due to not having cookies enabled; (vii) for traffic congestion on the Internet; (viii) the security or privacy of information transmitted via computer networks; (ix) breaches of privacy due to interference by third party computer "hackers" or for any damage caused to or incurred by any entrant or any other person by reason of any such event or occurrence; or (x) technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted entries, virus, worm or Trojan Horse damage or any other damage which may limit a participant's ability to participate in the Contest.

By entering the Contest, selected entrant hereby grants to the Sponsor the unlimited right (but not the obligation) to publish and use, without payment or other compensation and without notice, consent or approval, his/her name, photograph and likeness, address (city/town, state, province or territory), voice, and the whole or part of any statement or statements he/she has made or makes about the Contest or Prize awarded in any publicity, program or advertising, without geographic limit and in perpetuity, in any medium now known or hereafter devised (including, without limitation, the Internet), and hereby consents unconditionally to any such publication or use without further notice, consent, approval or compensation.

The Sponsor reserves the right to disqualify any individual that it finds to be violating these Rules or tampering with the entry process. The Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. Any attempt by anyone to deliberately undermine the legitimate operation of this promotion is in violation of criminal and civil laws and the Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law. The Sponsor reserves the right to terminate the Contest, suspend the Contest or to amend these Rules at any time without notice if any factor interferes with the proper conduct of the contest as contemplated by these Official Rules. The Sponsor is not responsible for printing, distribution or production errors. Entry material/data that have been tampered with or altered are void. The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry.

In the event of a dispute, entries will be deemed to have been submitted by the authorized account holder (defined below) of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is: (a) assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address with the selected entry. If the identity of an entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address. The sole determinant of the time for the purposes of a valid entry in this Contest will be the contest server machine(s).

The Sponsor reserves the right to cancel or suspend this Contest or change these Rules for any reason, at any time, at its sole discretion, without notice to participants, subject to approval from the Régie des alcools, des courses et des jeux du Québec (the "Régie"), including but not limited to lack of entrants, a virus, bug or other cause beyond the reasonable control of the Sponsor corrupting the security or proper administration of the Contest.

All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into, except with the selected entrant. The Contest is subject to all applicable Canadian federal, provincial and local laws and regulations. This Contest is VOID WHERE PROHIBITED BY LAW AND IS EXPRESSLY NOT OPEN TO PARTICIPATION BY RESIDENTS OF ANY JURISDICTION OTHER THAN CANADA.

For Québec residents only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

The Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and fulfill any prize requirements and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Sponsor. For more information regarding the manner of collection, use and disclosure of personal information by the Sponsor, please refer to the Sponsor’s privacy policy, available at www.whirlpool.ca.
